Terms of Service Agreement

Company: G's Shop Barber Shop LLC ("G's Shop," "we," "our," or "us")

This Terms of Service Agreement ("Agreement") governs your use of the services offered by G's Shop Barber Shop LLC (collectively, the "Services"), including any products, services, and communication tools available through us.

By accessing or using our Services, you agree to comply with and be bound by this Agreement. If you do not agree to these terms, you may not use the Services.

1. Use of Services

G's Shop offers a range of services, including barbering, digital marketing, and SMS communication tools. You agree to use our Services only for lawful purposes and in accordance with all applicable laws and regulations.

You must be at least 18 years of age or have express legal parental/guardian consent to use our Services.

2. Account Registration

You may be required to register an account or provide contact information to access certain features. You agree to provide accurate, complete, and current information, and to keep your details updated. You are responsible for safeguarding your login credentials.

3. A2P 10DLC SMS Messaging Compliance

G's Shop may use SMS messaging services in compliance with A2P 10DLC (Application-to-Person 10-Digit Long Code) messaging standards, as required by U.S. mobile carriers.

a. Consent Requirements

Before sending any SMS messages using our platform, you must obtain explicit opt-in consent from all recipients. Acceptable opt-in methods include:

Web form opt-in with a checkbox

Keyword-based SMS campaigns (e.g., “Text JOIN”)

In-person or written sign-ups

You are solely responsible for maintaining records of user consent.

b. Content and Opt-Out Compliance

All SMS messages must include:

The business or sender name

A method to unsubscribe (e.g., “Reply STOP to opt out”)

The following content is prohibited:

SHAFT (Sex, Hate, Alcohol, Firearms, Tobacco/Vape)

Fraudulent or misleading claims

Unapproved link shorteners

You must cease sending messages to any recipient who opts out immediately.

c. Data Handling

We store mobile numbers and related messaging data securely. We do not sell or rent your SMS data and use it only for the purposes for which you have consented.

d. Fees and Penalties

You are responsible for:

A2P 10DLC registration fees

Message delivery and usage fees

Fines from carriers for non-compliance

G's Shop reserves the right to suspend or terminate your SMS campaign for violations of A2P 10DLC standards.

4. Payments and Refunds

All service fees are outlined in your individual agreement or invoice. Payments are due as specified. Failure to pay on time may result in suspended services.

Due to the customized nature of our services, all sales are final. Refunds are issued at our discretion.

5. Prohibited Conduct

You agree not to:

Use our Services for spam, fraud, or illegal activity

Violate third-party rights (e.g., intellectual property, privacy)

Circumvent or interfere with security measures

Abuse our infrastructure or messaging tools

We reserve the right to terminate your access without notice if these terms are violated.

6. Intellectual Property

All content and software provided by G's Shop, including logos, designs, code, and campaigns, remain the property of G's Shop Barber Shop LLC, unless otherwise agreed in writing. You may not reproduce, redistribute, or use any part of the Services without our permission.

7. Privacy Policy

Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and protect your data. This includes your rights under data protection laws and specific policies related to SMS communications and tracking technologies.

8. Limitation of Liability

To the fullest extent permitted by law, G's Shop is not liable for:

Loss of data or business interruption

SMS delivery failures due to carrier filtering or delays

Indirect, incidental, or consequential damages

You agree to indemnify and hold G's Shop harmless from any claims, liabilities, or losses arising from your use of the Services or violations of this Agreement.

9. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, especially in cases of:

Non-compliance with this Agreement

Legal or regulatory violations

Abuse of SMS or digital platforms

Termination does not relieve you from any outstanding financial obligations or indemnity clauses in this Agreement.

10. Modifications

We may revise these Terms from time to time to reflect legal, regulatory, or operational changes. We will post any updated versions with a new “Effective Date” on this page. Your continued use of the Services constitutes acceptance of the updated terms.

11. Governing Law

This Agreement is governed by the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the courts of Los Angeles County, California.
